Casa Fuente Las Vegas Sues to Smoke!

Anyone who has visited the Casa Fuente Shop in the Forum Shops at Caesars Palace in Las Vegas has probably smoked a cigar on the popular patio out front. The Las Vegas smoking ban has threatened the patio privileges for those visiting the Fuente showcase store. The patio and store sit inside a mall where, according to the law, no smoking is allowed, but the patio is also part of the store itself, where smoking is permitted. Michael Frey, part owner of the Casa Fuente, sued this month to keep the patio open for smoking. "I am a cigar store", said Frey. "The law exempts cigar stores. so it does not matter that half the store is in the mall. I am exempt according to Nevada state law".

It will be a fight I am sure. The lawyers will suck up some money. However, the mall and Ceasars will not want to loose any revenue from cigar visitors.

In the end, I think Casa Fuente will win.

I hope anyway.
 
Dumb question: Does the patio face any other stores or should I assume the patio is outdoors? If it's outdoors and the ban wins, Lord help us all if our local B&Ms are next to other businesses and they complain about the smoke. At the least the store should be grandfathered, because it was built as a cigar store before the ban was put in place. :pp

:tpd: I hope he wins it too! The way the whole no smoking bans are spreading across the good ol USA is a bunch of :BS . I can see some places being smoke free for others benefits, BUT telling me I can't smoke in my own car or outside in the open air or in a cigar store for sh!ts sake is going a bit far IMO.

The patio is inside the Forums of Ceasers, but the patio is next door to the Playboy store and is across from Victoria Secrets, so there is a lot of eye candy around the area.

When I was there a few weeks ago, CF said if they lose the suit, they will enclose the patio, but I too hope they will prevail.
 
These bans are outta control. I hope Casa Fuente wins this one.

The fact that he has to sue to be able to have patrons smoke on his property means he's already lost once.

It's really sad. It's even sadder when you realize the idiots voting for these laws are generally driving vehicles that get about 10 mpg and produce more allergy/disease causing/environment destroying pollution in a single day than most cigar smokers cause in an entire year.
 
It is getting so bad here where I live in Canada, that the city is actually thinking of banning smoking in apartment buildings!

I hear California also has pending legislation banning smoking in non-single family residences. I always figgered they were like a foreign country anyway... I wonder whatever happened to the "behind closed doors" and "what I do in my home is my business" mentality?
 
Casa Fuente under the law should win, the building was built with the intention of having the patio there for smokers....I guess the tourists shopping at "Juicy Couture" are offended by smokers...Hell, the girls who shop there, regardless of how hot they are....they still look like they got up and decided to not try this morning...

Indeed. A "perfect storm" of neo-prohibitionists with deep pockets, half-assed pseudo-science presented as fact by an unquestioning media propaganda machine, and self-aggrandizing legislators desperate to pander to their ill-informed constituency. I am not optimistic about the future of indidvidual freedom in our society.
 
I spent 6 days in Vegas on a guys golf/gaming/herfing outing. No smoking in my condo, no smoking at the poker tables, but allowed playing blackjack? I'm not sure why this is but since I play poker and nothing else it was kind of a bummer although I can't stand cigarette smoke (go figure). It seems that cigar smoking is OK almost anywhere but where I wanted to smoke one, and don't get me started about the golf course because I played 3 days in 30 mph winds, very tough on your enjoyment of a fine smoke. I missed Casa Fuente but did check out one of the many Davidoff stores. I even saw the classic cigar cigarette girl wandering one casino cooing ... Cigars ... cigarettes ... tiparillos. I also saw this archived article about the Vegas cigar scene http://www.cigaraficionado.com/Cigar/CA_Archives/CA_Show_Article/0,2322,1763,00.html . Hopefully things won't change too soon.
