I agree with the above sentiments. Get yourself a good lawyer. Being a college student, I have had several buddies in the same situation as you. However, on the bright side, a lot of them got it plead down because they had no priors and good academics etc. etc. So, lawyer up, tell the truth and hang in there. Worst case you will have to catch a ride from some of your buddies for awhile and your wallet will be a bit lighter.
 
I talked to an attorney today, and I suppose I'm just going to get through this, however possible.

Thanks to all of the BOTLs for your support and advice. I realize it isn't a public matter, however I will post on this thread how things work out, if for any reason, as a means to see how this is affecting a fellow BOTL. My suggestions in these situations: Find a couch or Find a cab.

Hopefully, as a college student, my academics will begin to pay off early.

dude, I think you have a great attitude, and you have some serious advantages working for you that most judges will take into account:

1. Your vehicle was parked
2. You stated no priors, and hopefully your driving record is fairly clean
3. You are a student looking to better himself and contribute to society

You have not said yet, but your demeanor with the officer will also play a HUGE role in your sentence, at least here in VA it does. I am betting, with your understanding of the responsibility of the charge, you were polite and cooperative. As another poster said, lawyer up, tell the honest truth and should come out ok.

Thank you for the kind and comforting words. In the recent days, I have been gearing to better myself and become a formidable contribution to society. As I am told, and to the best my scattered memory serves me that morning, my demeanor with the police officers was on edge at first, but then smoothed out to a cooperative and polite state.

the thing that got you here was that your car was on....which means you either had recently driven it and were too drunk to remember to turn it off or you were planning on driving it at some point while being drunk...

sorry but this is what probably will get you in the end.
 
Good Luck. From what I've heard Ohio's DUI law can be beaten with a good lawyer. Granted the first thing they tell you to do is not take a breathalyser from I what I heard. I heard one of the lawyers who fights DUI's a few months back on 550 AM
 
Is thinking about committing a crime a crime in itself?

So he had too much to drink, got into his car, then realized he shouldn't drive and should sleep it off. He decided to turn on the radio and didn't realize he started the car. Does starting the engine constitute operating the vehicle?

Good luck with everything. It sounds like you have the right attitude and are looking at this as a learning experience. You're making the right call by seeking legal advice. Just make sure that next time you've thought about how you'll be getting home before you start drinking.

In some states, merely being behind the wheel with the keys in the ignition is enough. The engine does not have to be running.

Some states may also provide for a type of pre-trial diversion, which would allow a resolution of the charge without a finding of guilty.

Some states may also provide ways to have the charge expunged later, depending on the facts and the resolution of the the charge.

As you can tell, I know nothing about the law or procedures in Ohio.

I would wish you good luck but it is better to wish you a good lawyer. :)

I'm going to stick with the truth anyway, it may be my character, above all, that helps me in the end.

Definitely go with the truth... especially when you may not completely know what you told the police that night.

That is a startling issue that I am most worried about.

Either way, it's going to work out somehow, whatever I can get through will only make me stronger in the end, then I'll smoke an unparalleled stogie. :ss

Didn't Jack Bauer lop off some fingers in the last season of 24 with that cutter? If it's good enough to use to torture a potential terrorist sympathizer then it's good enough for a Tatuaje.

I know in Alabama people get hooked up all the time for sitting in their vehicle with their keys in their poswession and intoxicated. So for that part i know thats legal.

If you don't mind me asking what brought his or her attention to you?? Well keep us up to date and retain you a good lawyer that is known for working DUI's, oh see if you can get youthful offender status!!!!

Theres lot of options just be sure you sit down with your attorney and discuss them. Again good luck.

Definately not one of the last people I want to talk to, and you have some good words, BOTL (I hold nothing against P.O.s, especially a fellow BOTL). I have retained an attorney as of today, so I'm a bit at ease for that reason.

I don't mind you asking at all. This thread originally was to post a few cool pictures, and at last minute I decided "heck, why not ask around... BOTLs are informative and helpful on many subjects other than stogies." The police were responding to a complaint. I do not know who called it in. I was parked "in the middle" of my residential street, car running, and asleep.

This is what brought them to me, and thank you for the good luck. Like I said, what is dealt to me at this point, I have no control over. I will have to stay the course and stay strong to get anything out of this.

im a criminal justice major but im probably not going to follow through with going into law enforcement unless its a computer job since crime is just getting worse so id rather pass its too upsetting and stressful ........."ya know we live in a society "~george castanza
 
If it applies to anyone. I need advice on a DUI situation.

yea sorry to hear that, yea its better just to chill at a friends for the night, cops do alot of property checks and look for cars stopped on sides of roads at night, especially in my town lol if i wanna go out and park somewheres past 10:00 oclock at night and smoke a cigar they will 100% of the time stop and ask me ?'s thinking im doing drugs or something, especially at parks, its sad since were a free country but these crackheads and idiots ruin it for the rest of us lol

That is exactly what our Founding Fathers could not have predicted. All of these issues at present day. You have to think, back in that day, each town had a drunkard (is it illegal to ride a horse drunk? :r) and that was basically it... They're probably turning over in their graves with today's situations.

However, this incident was called in as a complaint from a neighbor. So I have to think to myself; which one of my neighbors could not come outside to check if I was okay, etc? :hn
