So did you talk to your attorney today??? Just curious to see if your state will allow what i was talking about with the youthful offender status.


I spoke with him this morning at court about the youthful offender status. He replied that it would be our last out. Basically, if we cannot fight the prosecution down to physical control, then that status will be our opt.

Regardless, I will be returning to school tomorrow and won't be worrying about this matter til' mid-October. I saw that as a bit of good news.
 
Well different states view youthful offender status differently here if you are granted you basically walk away with out the charge.

don't get me wrong you will know you've been charged cause you are going to go through all the fines and suspensions plus classes but it just won't show on you record. which is the main thing i'm sure you worried about that and putting this behind you.

dude this is a joke , obviously you were sleeping it off which is good since you didnt drive home like most idiots would, at least the cop wouldve said do it again your going to jail, but nah he had to lock ya up probably because he wanted to meet his "quota" , but thats not "politically correct anymore" i believe cops have it in for us even if we are good people, i remember driving i was driving my mustang gt and it was raining pretty bad, im going down a small highway and the light turns yellow at the time i didnt what to do due to the fact that if i tried slowing down i probably wouldve lost control of my car so i go through it, it turns red right when i probably hit the white line so i go through and the cop that was waiting to cross turns and pulls me over gives me a ticket.... forget about court they didnt understand , i guess i shouldve hit a pole lol

Well, they responded to a concerned neighbor. As the police were doing their job, my neighbor was calling me in? What a nice neighborly gesture! Anyway, I did drive home, and then fell asleep parked right in front of my house. I didn't say that though.


Thanks for the rant anyway :tu, and in your situation, that was pretty iffy. I would've taken that to court... I hear pleas of that sort dropped all of the time.
 
I just wanted to say good luck with the problems you are haveing with this.I know things will be tough for a while,I have gone through it myself.I got a DUI on 1/11/1986,It sucked but it wasn't the end of the world.I learned a valuable lesson from it,and I am now an OTR truck driver.I hope you Learn the same thing I did,Driveing drunk is a very foolish thing to do,and Taxi's are a lot cheaper than DUI's:D Hang in there it will get better....Joe

Thanks for the supportive words on this matter. If you don't mind me asking, how did you become a truck driver? I thought receiving a DUI makes it impossible to obtain a CDL.

Cops have it in for us?! Are you serious? Most cops that I've dealt with are totally understanding of extenuating situations (not all the time, but most of the time). My brother in law is a cop and he's a helluva guy who rarely gives DUI's (unless you are totally wasted and are a prickhead to him). If the drunk guy is near the limit and is totally cooperative and polite, he makes the guy leave the car where it's parked and waits with him while a sober driver comes to pick him up. He doesn't want to ruin anyone's life! He's all about helping people out as long as they are truthful, polite, and cooperative. Schweiger is in a chitty situation, but hey, he deserves it. He drove home wasted and passed out in his car. Schweiger, we've all driven when we shouldn't have, and hopefully learned from it. I know I've done it, and I've been lucky enough to make it home safely, but it isn't worth it for me. A drunk recently hit my father in law and almost killed him. Anyway, I'm glad you are ok, and it sounds like this was a life changing event for you. Back to the "cops have it out for us," cops (as a whole) risk their lives dealing with the scum of the earth on a daily basis. A cop pulls you over and gives you a ticket, big effing deal. I get tickets all the time. It's not the cop's fault, it's mine for breaking the law! It sucks being in trouble with the law, but instead of bitching about law enforcement for doing their jobs, maybe we ought not give them a reason to mess with us?! Take it like a man, learn from it, and hopefully your lawyer can convince the judge that it was a one time mistake that you've learned from. I'm a cop also. I will never leave a drunk behind the wheel of a car. If you are passed out in the roadway or a parking lot you get a DUI. If you are passed out in your car in your driveway, farm road, ect you get a public drunk. I could give DUIs in those instances but I usually don't

My reason...You are a liability to the community and yourself. Having seen death first hand from DUI crashes makes one appreciate the seriousness of the mater.

The young guy that got the DUI seems to have learned a bit from his experence. Not all people that get DUI's are bad folks.

One more thing...Drinking to the point of passing out is really dangerous. From my past experence most people that do that have some sort of a problem. If you do please seek help...If you're serious about it the court I work in will bend over backwards to help.

I'll appreciate this rant/reply to southjerzgt's post. You're right, not all police officers come across as taking a pleasure in citations and arrests. I will be the first to say (with confidence) that West Chester Police, in general, would much rather give a citation and a pair of handcuffs than a break. So yes, do police officers put up with the grunge and scum of America? Absolutely. Does the W.C.P.D.? Not so much, in my opinion.

I thought so too,but I found out a few years ago that they only go back 5 or 10 years with there checks.but that's only for the 1st,more than that and none of the major carriers will touch you.mine was 21 years ago when I was 19 ,and the only thing I've ever been arrested for.

Again, from earlier in this thread, I had not gotten any sleep (at all) the night before and was exhausted to an unbelievable point. I do believe this was part of the "falling asleep" or "passing out."

I hope the Butler County Area III court is also in the practice of bending over backwards to help.

As I had promised to those gorillas which were following this series of events, I have an update on the situation. Today, I stood before trial at The Butler County Court and to my pleasant suprise, had the issue resolved fairly easily.

The OVI charge was dropped to a Physical Control.

In addition, I will have the chance to have the incident expunged in six months (so long as I am flying straight:tu).

In the end, the justice system worked on me, I have learned from this mistake.
