Dear Mr. Generate:
Thank you for sharing your views regarding current anti-smoking efforts. As you are aware, two initiative petitions addressing the use of smoking tobacco were circulated throughout the state and submitted to Nevada Secretary of State Dean Heller. Secretary of State Heller deemed both petitions valid and presented them to the Nevada Assembly on February 7, 2005. Copies of the petition language may be viewed on the Nevada Legislature’s website at

On March 9, 2005, the Assembly Committee on Judiciary considered both initiative petitions and decided not to take action on either one. Some parties voiced concern that Initiative Petition 1 was too restrictive while others felt that Initiative Petition 2 did not go far enough. The Nevada Constitution provides that if an initiative petition is rejected or is not acted upon by the Legislature within 40 days from the day it is received, the Secretary of State must submit the initiative question to the voters for approval or disapproval at the next general election. Since the Assembly Judiciary Committee chose not to act on the petitions, both will automatically be placed on the ballot for the 2006 General Election. The decision now rests with the voters.
Another anti-smoking measure, Assembly Bill 118, passed the Assembly last week and was referred to the Senate Committee on Judiciary on April 15. This measure would prohibit smoking in video arcades and revise the provisions governing smoking in child care facilities. While I have not yet had an opportunity to review the bill, I am supportive of efforts to protect children and youth from the dangers of secondhand smoke in child care facilities and other areas frequented by children.
As a concerned citizen, you may wish to monitor the Legislature’s website for further developments on this issue. The Nevada Legislature’s website (
www.state.nv.us) contains detailed information on all introduced legislation, including scheduled hearing dates, that is updated daily.
Again, I appreciate your thoughts and will keep your comments in mind should A.B. 118 or other legislation that restricts smoking be considered by the full Senate.
